Terms of Service

Agentha AI ("the Service", "we", "us") is operated by Om Naphade. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or use the Service under the supervision and with the consent of a parent or legal guardian who agrees to these Terms on your behalf. You must provide accurate account information and keep your Google account secure; activity under your account is your responsibility.

2. The Service

Agentha AI provides access to artificial-intelligence chat models operated by third-party providers, through time-limited access passes. Model names displayed in the Service are product labels; the underlying models, their capabilities, availability and the set of models offered may change, be renamed, added or withdrawn at any time without notice and without compensation.

3. Passes, pricing and payment

  • Passes are prepaid and time-based (for example 24 hours or 7 days). A pass starts at the moment of activation and runs continuously by the clock until it expires, whether or not you use the Service during that time.
  • Passes do not auto-renew. No recurring charges are ever made; when a pass expires you simply purchase a new one if you wish.
  • Payments are processed by Razorpay. We never receive or store your card, UPI or banking credentials.
  • Prices are shown in Indian Rupees, are inclusive of applicable taxes unless stated otherwise, and may be revised at any time. Revisions do not affect passes already purchased.
  • Refunds and cancellations are governed exclusively by our Refund & Cancellation Policy.

4. Fair use

"Unlimited conversations" means you are not charged per message. It is not a guarantee of unlimited computational capacity. To keep the Service fast and available for everyone, usage is subject to fair-use limits — including caps on messages within rolling time windows, and tighter caps on certain premium models. These limits may be adjusted at any time without notice. Reaching a fair-use limit is a normal part of the Service and does not entitle you to a refund, extension or compensation.

5. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or to generate unlawful content;
  • attempt to generate content that sexualises minors, facilitates violence, self-harm, weapons, malware or fraud, or harasses or defames any person;
  • access the Service through scripts, bots, scrapers or any automated means, or attempt to extract, resell or redistribute model access;
  • share, sell or transfer your account or pass, or circumvent fair-use limits, pricing or safety measures;
  • probe, disrupt or overload the Service or attempt to access data of other users.

We may throttle, suspend or permanently terminate accounts that breach this section, without prior notice and without refund of any active pass.

6. AI-generated content

Responses are generated by artificial intelligence and may be inaccurate, incomplete, outdated, offensive or otherwise unsuitable. Nothing produced by the Service is professional advice of any kind — medical, legal, financial, tax or otherwise — and must not be relied upon as such. You are solely responsible for evaluating, verifying and for any use you make of generated content. Similar or identical content may be generated for other users.

7. Your content

You retain rights to the prompts you submit. You grant us and our model providers the right to process, transmit and store your prompts and the resulting conversations as needed to operate, secure and improve the Service and to comply with law. You are responsible for ensuring your prompts do not infringe the rights of others. As between you and us, we claim no ownership over generated responses to your prompts.

8. Intellectual property

The Service, including its name, branding, design, software and content (other than your conversations), belongs to us or our licensors. You may not copy, modify or create derivative works from it.

9. Availability and disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant uninterrupted or error-free operation, any particular response speed or quality, or the continued availability of any specific model. Third-party providers on which the Service depends (AI models, hosting, payments, search) may experience outages beyond our control.

10. Limitation of liability

To the maximum extent permitted by applicable law: (a) we are not liable for any indirect, incidental, special, consequential or exemplary damages, or for lost profits, data or goodwill, arising from or relating to the Service; and (b) our total aggregate liability for all claims relating to the Service is limited to the amount you paid for the pass active at the time the claim arose, or ₹115, whichever is lower. Nothing in these Terms excludes liability that cannot be excluded under Indian law.

11. Indemnity

You agree to indemnify and hold us harmless from claims, damages and expenses (including reasonable legal fees) arising out of your use of the Service in breach of these Terms or of applicable law.

12. Termination

You may stop using the Service at any time and may request account deletion via the Contact page. We may suspend or terminate access immediately for breach of these Terms or where required by law. Sections 6–11 and 13–14 survive termination.

13. Changes to these Terms

We may update these Terms from time to time. The current version is always available at this page with its "Last updated" date. Continued use of the Service after an update constitutes acceptance.

14. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to any mandatory consumer-law rights, the courts at Roorkee, Uttarakhand shall have exclusive jurisdiction over disputes arising from the Service.
